FESTFOOD TERMS OF SERVICE

Effective Date: September 24, 2026

Welcome to FESTFOOD. These Terms of Service (“Terms”) govern your access to and use of the FESTFOOD website, online training programs, course materials, assessments, certificates, and related services (“Services”).

By creating an account, purchasing a course, accessing training materials, or otherwise using the Services, you agree to these Terms.

1. FESTFOOD Services

FESTFOOD provides educational training related to food safety practices in festival, event, food truck, concession, temporary food service, pop-up, and outdoor food-service environments.

Course content may include video instruction, educational materials, quizzes, assessments, and certificates of completion.

2. Educational Training Disclaimer

FESTFOOD is an independent educational training program.

Unless expressly stated otherwise for a particular course or jurisdiction, completion of a FESTFOOD course does not constitute a government-issued food-handler permit, professional license, regulatory certification, or guarantee that the training satisfies a particular state, county, city, employer, festival, or health-department requirement.

Requirements vary by jurisdiction and employer. Students and employers are responsible for determining which licenses, permits, certifications, or training are legally required for their particular activities.

3. Course Access

Course access is provided to the individual associated with the account through which the course was purchased or assigned.

You may not sell, share, transfer, sublicense, reproduce, distribute, record, or publicly display FESTFOOD course materials except with written authorization from FESTFOOD.

Account credentials may not be shared with another person.

4. Assessments and Course Completion

Certain FESTFOOD courses require successful completion of an assessment.

For the FESTFOOD Festival Food Safety Training course, learners must achieve the passing score specified in the course before receiving a Certificate of Completion.

Students are responsible for completing assessments themselves and providing accurate information associated with their account and certificate.

5. Certificates of Completion

A Certificate of Completion indicates that the named learner satisfied FESTFOOD’s applicable course-completion requirements.

Certificates may include the learner’s name, course name, completion date, expiration date where applicable, and certificate identification information.

A FESTFOOD Certificate of Completion must not be altered, falsified, transferred, or represented as belonging to another person.

FESTFOOD may revoke or invalidate a certificate obtained through fraud, impersonation, manipulation of the training system, or other violation of these Terms.

6. Purchases and Payment

Prices are displayed before purchase.

Payments may be processed by third-party payment processors, including Stripe, and through the Thinkific platform.

By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable charges shown during checkout.

7. Refunds

Purchases are subject to the FESTFOOD Refund Policy displayed on our website and incorporated into these Terms.

Nothing in these Terms limits refund or cancellation rights that cannot legally be waived under applicable law.

8. Intellectual Property

FESTFOOD’s courses, videos, graphics, assessments, training materials, branding, logos, designs, written content, and other original materials are owned by or licensed to FESTFOOD and are protected by applicable intellectual-property laws.

Purchasing a course grants you a limited, personal, non-exclusive, non-transferable right to access the purchased training for its intended educational purpose.

Purchasing access does not transfer ownership of any FESTFOOD intellectual property.

9. Prohibited Conduct

Users may not copy or redistribute course materials; record or republish training videos; share accounts; circumvent access restrictions; manipulate assessments or completion records; create fraudulent certificates; interfere with the operation or security of the Services; or use FESTFOOD intellectual property without authorization.

10. Availability and Changes

We may update course content, assessments, features, pricing, policies, or website functionality from time to time.

We may temporarily suspend access for maintenance, security, technical issues, suspected fraud, or violations of these Terms.

11. No Guarantee of Employment or Regulatory Acceptance

Completing FESTFOOD training does not guarantee employment, placement at an event or festival, regulatory approval, or acceptance by any particular employer, venue, health department, or government authority.

12. Limitation of Liability

To the maximum extent permitted by applicable law, FESTFOOD and its owners, affiliates, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the Services.

Nothing in these Terms excludes liability that cannot legally be excluded.

13. Third-Party Services

FESTFOOD may use third-party providers to operate portions of its Services, including Thinkific for course delivery and Stripe or other payment providers for payment processing.

Those providers may process information according to their own applicable terms and privacy practices.

14. Termination

We may suspend or terminate access when we reasonably determine that a user has violated these Terms, committed fraud, misused course materials, compromised platform security, or used the Services unlawfully.

15. Changes to These Terms

We may update these Terms periodically. Updated Terms will be posted with a revised effective date.
